Before Reading Our Terms

Here are the most important things you should know:

  • Voxa is a wellness app, NOT a medical device – We don’t diagnose, treat, or provide medical advice
  • Your data is yours – You can export or delete it at any time
  • We protect your privacy – Health data is encrypted and never sold
  • Subscriptions renew automatically – Cancel at least 24 hours before renewal through your App Store or Play Store account
  • Always consult healthcare professionals – Voxa supplements, never replaces, medical care
  • We use AI to help, not decide – Organizes your data, never gives medical advice
  • UK law applies – But your local consumer protections are preserved
  • Your consumer rights are protected – Nothing in these Terms limits rights that cannot be waived by law

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and VOXA HEALTH LTD (“Voxa”, “we”, “us”, “our”), a company registered in England and Wales (Company Number: 16500907), with its registered office at 20 Wenlock Road, London, N1 7GU, England.

By downloading, installing, or using the Voxa application (“App”), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

You must be at least 18 years old to create an account. If you are a parent or guardian of a dependent who is younger than the legal age of majority in your location of residence, you may accept these Terms on behalf of the minor dependent.

2. About Voxa

Voxa is a wellness application that allows you to:

  • Track symptoms and health patterns through conversational logging
  • View insights and correlations in your tracked data
  • Prepare summaries for healthcare appointments
  • Export your health data

2.1 Important: Voxa is Not a Medical Device

IMPORTANT: VOXA IS A WELLNESS TOOL, NOT A MEDICAL DEVICE.

The App is designed for general wellness and self-tracking purposes only. Voxa:

  • Does NOT diagnose any medical condition
  • Does NOT provide medical advice
  • Does NOT replace professional healthcare
  • Is NOT intended to treat, cure, or prevent any disease
  • Is NOT regulated as a medical device

Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information you have tracked or viewed in Voxa.

IN CASE OF A MEDICAL EMERGENCY, CALL YOUR LOCAL EMERGENCY SERVICES IMMEDIATELY.

3. Account Registration

3.1 Account Creation

To use certain features of the App, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You agree to:

  • Keep your password confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

3.3 Account Termination

You may delete your account at any time through the App settings or by contacting hello@voxahealth.com. Upon account deletion, your data will be permanently removed within 30 days in accordance with our Privacy Policy.

4. Subscription and Payments

4.1 Free Trial

We may offer a free trial period. The length of the free trial will be displayed in the App at the time of signup. If you decide not to subscribe before we start charging your payment method, you must cancel the subscription at least 24 hours before the free trial ends. Any unused portion of a free trial will be forfeited if you purchase a subscription to Voxa.

4.2 Subscription Terms

  • Subscriptions are offered on a monthly or annual basis
  • Prices are displayed in the App and may vary by region
  • All prices include applicable taxes

4.3 Auto-Renewal and Billing

IMPORTANT

If you subscribe through the Apple App Store or Google Play Store:

  • Payment will be charged to your account at the confirmation of purchase.
  • Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen subscription.
  • You can manage and cancel your subscriptions by going to your account settings in the respective app store after purchase.

4.4 Payment Processing

Payments are processed through the Apple App Store or Google Play Store. The legal relationship associated with the purchase and any consumer rights are with the respective Store, not Voxa directly. Payment terms of the respective Store apply.

4.5 Cancellation and Refunds

  • You may cancel your subscription at any time through your app store account settings
  • Cancellation takes effect at the end of the current billing period
  • Refund requests must be directed to the Apple App Store or Google Play Store in accordance with their refund policies

4.6 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle after notice is given.

5. Acceptable Use

5.1 You Agree NOT To:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the App’s functionality
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to transmit malware or harmful code
  • Impersonate any person or entity
  • Use the App in any way that could harm Voxa or other users

5.2 User Content

You retain ownership of any content you submit to the App. By submitting content, you grant Voxa a limited license to process this data solely for the purpose of providing the App’s services to you.

6. Intellectual Property

6.1 Voxa’s Rights

The App, including its design, features, code, and content, is owned by VOXA HEALTH LTD and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6.2 Restrictions

You may not:

  • Copy, modify, or distribute the App
  • Rent, lease, loan, sell, or sublicense the App
  • Create derivative works based on the App
  • Use Voxa’s trademarks without permission

7. AI and Data Processing

7.1 Use of AI Technology

Voxa uses artificial intelligence to:

  • Parse natural language input into structured health data
  • Identify patterns in your tracked symptoms
  • Generate questions to help you log comprehensive information

7.2 AI Limitations

What the AI Does NOT Do

The AI is used solely to assist with data organization and pattern recognition. It does NOT:

  • Provide medical diagnoses
  • Offer treatment recommendations
  • Replace clinical decision-making
  • Generate medical advice

All insights are statistical observations based on your logged data and should not be interpreted as medical conclusions.

7.3 Third-Party AI Processing

We use Google Gemini AI to process your symptom descriptions. When you submit a symptom entry:

  • Only your symptom text is sent to Gemini (no names, emails, or account identifiers)
  • Google retains your symptom descriptions for 55 days for abuse detection and safety monitoring, then permanently deletes them
  • Your data is NOT used to train or improve Google’s AI models
  • Google is bound by the Gemini API Terms of Service, which prohibit use of customer data for model training

8. Data Privacy

8.1 Privacy Policy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the App, you consent to the practices described in our Privacy Policy.

8.2 Health Data

We recognize the sensitive nature of health data. Your symptom logs, health patterns, and personal information are:

  • Encrypted in transit and at rest
  • Never sold to third parties
  • Never used for advertising or marketing
  • Only processed to provide the App’s services

8.3 Data Rights

In accordance with applicable data protection laws (including UK GDPR and Canadian PIPEDA), you have rights regarding your personal data, including:

  • Right to access your data
  • Right to correct inaccurate data
  • Right to delete your data
  • Right to export your data
  • Right to withdraw consent

9. Disclaimers

9.1 No Medical Advice

IMPORTANT: THE APP DOES NOT PROVIDE MEDICAL ADVICE.

The content, features, and insights provided through Voxa are for informational and wellness tracking purposes only. They are not intended to be a substitute for professional medical advice, diagnosis, or treatment.

9.2 No Warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • The results obtained from using the App will be accurate or reliable

9.3 Accuracy of Information

While we strive to provide accurate pattern recognition and insights, we cannot guarantee:

  • The accuracy of symptom categorization
  • The completeness of correlation analysis
  • The reliability of trend predictions

You are responsible for reviewing and verifying any data before sharing it with healthcare providers.

10. Limitation of Liability

10.1 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOXA SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, use, goodwill, or other intangible losses
  • Any damages resulting from your use or inability to use the App
  • Any decisions made based on information provided by the App

10.2 Maximum Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

10.3 Consumer Rights Protection

Nothing in these Terms excludes or limits any liability which cannot be excluded or limited under applicable law, including consumer protection laws. In particular, nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 (UK), PIPEDA (Canada), or other applicable consumer protection legislation.

10.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless VOXA HEALTH LTD, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit through the App

12. Third-Party Services

12.1 External Services

The App may integrate with third-party services. Your use of such services is subject to their respective terms and privacy policies.

12.2 No Endorsement

Voxa does not endorse or assume responsibility for any third-party services or content.

13. Modifications to Terms

13.1 Changes

We may modify these Terms at any time. Material changes will be communicated through:

  • In-app notifications
  • Email to registered users
  • Updates to the “Last Updated” date

13.2 Continued Use

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App.

14. Termination

14.1 By You

You may terminate your account at any time by deleting your account through the App settings.

14.2 By Voxa

We may suspend or terminate your access to the App at any time if:

  • You violate these Terms
  • Your use poses a security risk
  • Required by law

14.3 Effect of Termination

Upon termination:

  • Your license to use the App ends immediately
  • Your data will be deleted within 30 days in accordance with our Privacy Policy
  • Provisions that by their nature should survive termination will remain in effect (including Sections 6, 9, 10, 11, and 16)

15. App Store Terms

15.1 Apple App Store

If you downloaded the App from the Apple App Store, you acknowledge that:

  • This agreement is between you and VOXA HEALTH LTD only, not with Apple Inc. Apple is not responsible for the App or its content.
  • The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
  • Voxa, not Apple, is solely responsible for providing maintenance and support services for the App. Apple has no obligation to provide any maintenance or support services.
  • Voxa, not Apple, is responsible for any product warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
  • Voxa, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar legislation.
  • In the event of any third-party intellectual property claim, Voxa, not Apple, is solely responsible for investigation, defense, settlement, and discharge of such claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you.

15.2 Google Play Store

If you downloaded the App from the Google Play Store, you acknowledge that:

  • This agreement is between you and VOXA HEALTH LTD only, not with Google LLC. Google is not responsible for the App or its content.
  • Google Play’s terms of service apply to your use of the Google Play Store.
  • Voxa, not Google, is solely responsible for the App, the content therein, maintenance and support services, warranties, and any claims related to the App.
  • Google has no obligation or liability to you with respect to the App or these Terms.

16. Governing Law and Disputes

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

16.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If resolution is not reached within 30 days, disputes shall be submitted to the jurisdiction of the courts of England and Wales.

16.3 Mandatory Consumer Protections

Nothing in these Terms shall deprive you of any mandatory consumer protections granted under the laws of your country of residence. If you are a consumer residing in the European Union, United Kingdom, or Canada, you may also bring proceedings in the courts of your country of residence, and the mandatory consumer protection laws of your country of residence shall apply to the extent they provide greater protection than the laws of England and Wales.

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Voxa regarding the App.

17.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

17.3 Waiver

Failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms. Voxa may assign its rights and obligations without restriction.

17.5 Force Majeure

Voxa shall not be liable for any failure or delay due to circumstances beyond our reasonable control.

Your rights under PIPEDA and applicable provincial privacy laws are fully respected. You may contact the Office of the Privacy Commissioner of Canada at: https://www.priv.gc.ca

If you are in a province with substantially similar health privacy legislation (Ontario, Nova Scotia, New Brunswick, Newfoundland and Labrador), those laws also apply to the handling of your health information.
